  • Digistore24 is responsible for the payment process, invoicing, and handling of refunds.

All product descriptions and specifications are provided on our website. Please note that these are digital goods and are not supplied on a tangible medium.

 

  1. Pricing and Payment

Prices for our digital products are displayed on our website and on the Digistore24 sales pages. All prices are final and include applicable taxes (e.g., VAT/sales tax), unless otherwise stated by Digistore24 during the checkout process.

Payment is processed securely by Digistore24. We do not process or store your payment information directly.

 

  1. Delivery of Digital Products

Upon successful completion of the purchase and payment via Digistore24, your digital products will be made available to you for download or access immediately. You will typically receive an email from Digistore24 with a download link or access instructions.

You are responsible for ensuring that you have the necessary software and hardware to open, use, and store the digital products.

 

  1. Usage Rights

Upon successful purchase and payment, Zagrebin Polenz GbR Juicy Frames Media grants you a non-exclusive, non-transferable, perpetual license to use the purchased digital products (presets/chordsets, email courses, online courses) as follows:

  • Permitted Use:
  • You may use the digital products for your personal and commercial projects. This includes using them in your own music productions, videos, multimedia projects, and for projects you create for your clients.
  • You are permitted to modify the digital products (e.g., adjust chords in a chordset, adapt course materials for personal learning) for your use in personal and commercial projects.

 

  • Prohibited Use:
  • You are expressly prohibited from reselling, redistributing, sublicensing, leasing, lending, sharing, or otherwise making the digital products (whether in their original or modified form) available to any third party as a standalone product or as part of a product that directly competes with our offerings.
  • You may not use the digital products in a way that allows a third party to extract, copy, or access the products as individual assets.
  • The usage-right is granted to the individual purchaser and is not transferable to another person or entity.

No ownership or intellectual property rights are transferred to you; you are only granted the specified usage rights.

 

  1. Right of Withdrawal

As our digital products are sold through Digistore24, your right of withdrawal is governed by the terms provided by Digistore24 and our separate “Right of Withdrawal / Cancellation Policy”.

Please be aware that for contracts concerning the supply of digital content which is not supplied on a tangible medium, your right of withdrawal expires if the performance has begun with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal. By completing the purchase and gaining access to the digital product (e.g., by downloading or accessing the content), you typically give such consent and acknowledge the loss of the right of withdrawal.

  1. Warranties and Liability
  • Product Quality: We strive to ensure that our digital products are of high quality and as described. However, digital products are provided “as is” without any express or implied warranties regarding their suitability for a particular purpose beyond their general functionality as described.
  • Availability: We do not guarantee uninterrupted or error-free access to our website or the delivery of digital products.
  • Liability: We shall only be liable for damages caused by intent or gross negligence. Our liability for slight negligence is excluded, except for damages resulting from injury to life, body, or health, or from the breach of essential contractual obligations (cardinal duties). In case of breach of cardinal duties due to slight negligence, our liability shall be limited to typical, foreseeable damages.

Should any provision of these T&Cs be determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these T&Cs, such determination shall not affect the validity and enforceability of any other remaining provisions.
